IT and IP

While technology has become increasingly important to business success, problems and disputes concerning information technology (IT) and intellectual property (IP) have also become more common.

Having represented suppliers and users of all types of technology and IT-related goods and services, our firm has a broad and deep knowledge of contractual and IP rights issues. As a result, we can provide the specialist expertise needed to help our clients on IP/IT-related disputes.

Our understanding of the commercial context in which disputes arise means we are able to resolve them effectively.  We have lawyers who are specialists at drafting technology contracts and are experienced in assessing and advising on the management of IT and IP-related business risks.  Our team is also well equipped to enforce IT and IP rights swiftly and decisively.

Some of the areas we work on include:
  • disputes concerning the sale and supply of IT-related goods and services, particularly systems implementation disputes, disputes over project scope and 'quality' disputes;
  • exclusion and limitation of liability in IT contracts;
  • software development, licensing, marketing, and distribution disputes;
  • outsourcing disputes, including 'benchmarking' and service-level issues and employment implications;
  • trademark and copyright infringement and passing-off claims;
  • e-commerce issues including website content and related disputes, and domain name disputes; and
  • internet and e-mail risks and claims, and e-risks insurance.
Our active IT dispute resolution team's clients include 3, Fujitsu, PwC and Dixons Group plc. The firm's litigation practice is praised by leading legal directories such as Chambers & Partners as "a great outfit that puts up a fair fight".

Recent major cases we have handled include acting for Dixons Group plc on brand protection and for 3 against Team Telecom International in a case involving third-generation mobile services.
